These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and related services (collectively, the "Services") through which you may buy event tickets for concerts, sports events, theatre performances, festivals, and other live entertainment experiences in Ireland and across Europe.

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Services. We reserve the right to modify these Terms at any time, and your continued use of the Services following any changes constitutes your acceptance of the revised Terms.

These Terms apply to all visitors, users, and others who access or use the Services. By using our platform to buy tickets, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into binding agreements. If you are purchasing tickets on behalf of another person or entity, you represent that you have the authority to bind that person or entity to these Terms.

2. Description of Services

Emerald Tickets Ltd. operates an online ticketing platform that enables customers to buy event tickets for a wide variety of live entertainment experiences. Our Services include browsing available events, selecting seats or admission types, processing secure payments, and delivering electronic or physical tickets to purchasers. We partner with event organisers, venues, and authorised ticket distributors to provide access to premium entertainment experiences.

Our platform provides detailed event information including dates, times, venue locations, seating charts, and pricing. We strive to ensure that all event listings are accurate and up to date; however, we cannot guarantee that all information will be unrestricted from errors or omissions. Event details, including performer lineups, start times, and venue arrangements, are subject to change by the event organisers without prior notice.

We may also offer additional services such as event notifications, personalised recommendations, group booking assistance, and customer support for ticket-related inquiries. The availability of these supplementary services may vary and may be subject to additional terms and conditions.

Our Services are intended for personal, non-commercial use only. You may not use our platform to purchase tickets for the purpose of commercial transfer unless you have obtained explicit written authorisation from Emerald Tickets Ltd. and the relevant event organiser.

3. User Accounts and Registration

To access certain features of our Services, including the ability to buy tickets, manage your orders, and receive event updates, you may be required to create a user account. When registering, you agree to provide accurate, current, and complete information as prompted by the registration form. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorised access to or use of your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion if we suspect fraudulent, abusive, or otherwise inappropriate activity.

Each individual may maintain only one account on our platform. Creating multiple accounts to circumvent purchase limits, gain unfair access to tickets, or otherwise manipulate our systems is strictly prohibited and may result in the cancellation of all associated orders and permanent suspension from our Services.

4. Ticket Purchases and Pricing

All ticket prices displayed on our platform are denominated in Euro (€) and include applicable Value Added Tax (VAT) unless otherwise stated. The total price for your ticket purchase, including any service charges, booking fees, and delivery costs, will be clearly displayed before you confirm your order. We believe in transparent pricing and ensure that you see the full cost before completing any transaction.

When you buy event tickets through our platform, you are entering into a contract with Emerald Tickets Ltd. for the supply of those tickets. Your order constitutes an offer to purchase, and the contract is formed only when we send you a confirmation email with your ticket details. We reserve the right to refuse or cancel any order for any reason, including but not limited to pricing errors, suspected fraud, or unavailability of tickets.

Ticket prices are subject to change without notice until your order is confirmed. Once a purchase is completed and confirmed, the price is guaranteed and will not be subject to subsequent changes. We accept major credit and debit cards, as well as other payment methods as displayed at checkout. All payments are processed through secure, PCI DSS-compliant payment gateways.

Purchase limits may apply to certain events to ensure fair access for all customers. These limits will be clearly communicated on the relevant event page. Any orders that exceed stated purchase limits may be cancelled without notice, and we reserve the right to cancel orders that we reasonably believe have been placed by the same individual using multiple accounts, payment methods, or identities.

5. Ticket Delivery and Access

Upon successful completion of your purchase, tickets will be delivered to you via the method selected at checkout. Available delivery options may include electronic tickets (e-tickets) delivered by email, mobile tickets accessible through our application, or physical tickets dispatched by post. Delivery timelines vary depending on the method chosen and the event date.

For electronic and mobile tickets, you are responsible for ensuring that the email address and phone number associated with your account are correct and accessible. Tickets will be sent to the contact details provided at the time of purchase. We recommend saving your tickets to your device before arriving at the venue to avoid any connectivity issues.

Physical tickets are dispatched via registered post to the delivery address provided during checkout. We recommend allowing sufficient time for delivery, particularly for international addresses. We are not responsible for tickets lost or delayed in transit if the correct delivery address was provided. In such cases, please contact our customer support team as soon as possible, and we will endeavour to assist you in obtaining replacement admission where possible.

6. Cancellations, Refunds, and Exchanges

All ticket sales are final once confirmed. Due to the nature of live entertainment events and in accordance with the European Union Consumer Rights Directive (2011/83/EU), the right of withdrawal does not apply to contracts for the supply of services related to leisure activities if the contract provides for a specific date or period of performance. This means that you do not have a statutory cooling-off period for ticket purchases.

Refunds will only be issued in the event that an event is cancelled by the organiser. In such cases, we will process refunds to the original payment method within 14 business days of the cancellation announcement. Service fees and delivery charges may or may not be refundable depending on the circumstances and the policies of the event organiser.

If an event is postponed or rescheduled, your tickets will generally remain valid for the new date. We will notify you of any schedule changes via the email address associated with your account. If you are unable to attend the rescheduled event, we will communicate any options available to you, which may include refunds or exchanges subject to the event organiser's policies.

We do not offer refunds or exchanges for changes of mind, personal scheduling conflicts, or inability to attend an event. We recommend that customers consider purchasing event insurance where available to protect against unforeseen circumstances that may prevent attendance.

7. Prohibited Conduct

When using our Services, you agree not to engage in any of the following prohibited activities:

  • Using any automated system, software, or bot to access our platform, purchase tickets, or interact with our Services in any manner that exceeds reasonable human usage patterns
  • Circumventing or attempting to circumvent any technical measures we implement to limit access, enforce purchase limits, or protect the integrity of our ticketing system
  • Providing false, misleading, or inaccurate information during the registration or purchase process
  • Attempting to interfere with, compromise, or disrupt the integrity or security of our systems, servers, or networks
  • Using our Services for any unlawful purpose or in violation of any applicable local, national, or international laws and regulations
  • Reselling tickets purchased through our platform without proper authorisation, or advertising tickets for transfer on third-party platforms
  • Harvesting or collecting personal information of other users from our platform
  • Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity

Violation of any of these prohibitions may result in immediate termination of your account, cancellation of all pending and future orders without refund, and potential legal action. We actively monitor for prohibited conduct and employ sophisticated detection systems to identify and prevent abuse of our platform.

8. Intellectual Property Rights

All content available through our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Emerald Tickets Ltd. or its content suppliers and is protected by Irish and international copyright, trademark, and other intellectual property laws.

The Emerald Tickets Ltd. name, logo, and all related marks, designs, and slogans are registered trademarks of Emerald Tickets Ltd. You may not use any of our trademarks without our prior written consent. All other trademarks not owned by us that appear on our platform are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us.

You are granted a limited, non-exclusive, non-transferable licence to access and use our Services for personal, non-commercial purposes. This licence does not include any right to modify, reproduce, distribute, create derivative works from, publicly display, or commercially exploit any content from our platform without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Emerald Tickets Ltd., its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) our Services.

We act as an intermediary between event organisers and ticket purchasers. While we take great care in selecting our partners and verifying event information, we are not responsible for the quality, safety, or legality of events advertised on our platform, nor for the acts or omissions of event organisers, venues, performers, or other third parties. Our liability is limited to the provision of ticketing services as described in these Terms.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under Irish law. Our total aggregate liability to you for all claims arising from or related to these Terms or our Services shall not exceed the total amount you paid to us for the specific tickets giving rise to the claim.

10. Privacy and Data Protection

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) and the Irish Data Protection Acts 1988-2018. Our collection, use, storage, and disclosure of personal information is governed by ourPrivacy Policy, which is incorporated into and forms part of these Terms of Service.

By using our Services, you consent to the processing of your personal data as described in our Privacy Policy. We implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk, including encryption of payment data, secure storage of personal information, and regular security assessments of our systems.

You have the right to access, rectify, erase, restrict, or port your personal data, as well as the right to object to processing and the right to lodge a complaint with the Data Protection Commission (DPC) in Ireland. 11. Indemnification

You agree to indemnify, defend, and hold harmless Emerald Tickets Ltd., its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, demands, actions, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to: (a) your use of our Services; (b) your violation of these Terms; (c) your violation of any rights of any other person or entity; or (d) your violation of any applicable laws or regulations.

We reserve the right, at our own expense, to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in defending such claims. You agree not to settle any matter subject to indemnification without our prior written consent.

12. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of Ireland.

Before initiating any legal proceedings, we encourage you to contact us directly to attempt to resolve any disputes amicably. We are committed to addressing customer concerns promptly and fairly. Most issues can be resolved through our customer support team without the need for formal dispute resolution procedures.

If you are a consumer residing in the European Union, you may also benefit from the provisions of the Online Dispute Resolution (ODR) platform provided by the European Commission. Additionally, nothing in these Terms shall affect your statutory rights as a consumer under applicable Irish and EU consumer protection legislation that cannot be contractually waived.

13. Modifications to Services and Terms

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We may also revise these Terms from time to time to reflect changes in our business practices, legal requirements, or service offerings. The most current version of the Terms will be posted on this page with an updated revision date.

For material changes to these Terms, we will provide notice through our platform or by email to the address associated with your account at least 30 days before the changes take effect. Your continued use of our Services after the effective date of any revised Terms constitutes your acceptance of such changes. We will not apply modified Terms retroactively to purchases made before the effective date of the changes. Any orders confirmed prior to a Terms update will continue to be governed by the Terms in effect at the time of purchase.

14. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Instead, such provision shall be modified to the minimum extent necessary to make it enforceable and valid, and the remaining provisions of these Terms shall continue in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. Except as expressly provided herein, the exercise by either party of any of its remedies under these Terms shall be without prejudice to its other remedies under these Terms or otherwise.
